2. Eligibility

• The Service is strictly provided to business users only (B2B), including solar installers, EPC companies, OEMs, and related organizations.
• Users must be 18 years or older to create an account.
• By registering, you confirm you are authorized to act on behalf of your business.

3. Accounts & Access

• Accounts are created via email/password login or through Google/Microsoft authentication.
• You are responsible for maintaining the confidentiality of your login credentials.
• SurgePV is not liable for unauthorized access resulting from failure to safeguard your credentials.

4. Services Provided

SurgePV provides a cloud-based solar design and proposal platform. Key features include (but are not limited to):

• AI-assisted solar layouts and shading analysis
• Proposal generation and financial modeling
• Bill of Materials (BOM) and documentation tools
• Collaboration features (team access, commenting, design review)

We continually improve and may add or remove features without prior notice.

5. User Content & Data

• You retain ownership of all data, designs, images, consumption profiles, and documents uploaded to SurgePV ("User Content").
• By uploading, you grant SurgePV a limited license to store, process, and use the User Content solely to deliver and improve the Service.
• You confirm that your uploads do not infringe on third-party rights or contain unlawful material.

6. Payments & Subscriptions

• SurgePV may be offered on a subscription basis via authorized payment processors (e.g., Stripe, Adyen).
• All fees are billed in accordance with the plan you select, once subscriptions are enabled.
• Refunds: SurgePV operates under a strict "No Refunds" policy. All payments are final.

7. Acceptable Use

You agree not to:

• Use the Service for unlawful, fraudulent, or abusive purposes.
• Reverse engineer, copy, or resell the Service.
• Upload malicious files, viruses, or harmful code.
• Misrepresent your identity or impersonate another entity.

8. Service Availability

• We strive for high availability but do not guarantee uninterrupted or error-free operation.
• SurgePV may suspend or limit access for maintenance, security, or other operational reasons.

9. Limitation of Liability

• SurgePV provides outputs such as solar designs, generation estimates, and financial models. These are for informational and planning purposes only.
• We do not guarantee accuracy, completeness, or suitability for specific projects.
• To the maximum extent permitted by law, SurgePV's liability is limited to the subscription fees paid by you in the 12 months prior to a claim.

10. Termination

• SurgePV may suspend or terminate accounts that breach these Terms.
• You may terminate your account at any time, but fees already paid remain non-refundable.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the courts of Gujarat, India, unless otherwise required by applicable law.

12. Changes to Terms

We may update these Terms from time to time. Updated versions will be posted on our website with a revised "Effective Date" and "Last Updated" line. Continued use of the Service constitutes acceptance of the updated Terms.
